Abstract

The free allocation of land plots under Federal Law № 119-FZ of 1 May 2016 combines a simplified regime of gratuitous use with the ordinary requirements of cadastral registration and state registration of rights, and it is at the junction of these two regimes that most of the difficulties faced by participants arise. A discrepancy between the plot outline drawn by an applicant on the public cadastral map and the data of the Unified State Register of Real Estate on the boundaries of forest districts, specially protected natural areas and previously registered plots produces suspensions of registration, refusals and a protracted securing of ownership. The aim is to determine at which stage of the life cycle of a Far Eastern hectare the cadastral and registration risks concentrate and by what instruments of the current legislation they are removed. The formal-legal and comparative-legal methods, systematic interpretation of the norms and generalisation of the law-enforcement practice of Rosreestr are applied; the quantitative dynamics of the programme for 2016-2025 is correlated with the data of the Ministry for the Development of the Russian Far East and the Far East and Arctic Development Corporation. It is established that the pivotal link is the transition from a contract of gratuitous use to a registered right: of roughly 180 thousand participants, about 40 thousand secured ownership or a long-term lease by 2025. Spatial overlaps are resolved mainly through the forest amnesty and boundary correction, whereas the infrastructural unpreparedness of plots lies beyond the cadastral and registration toolkit and calls for solutions of a different order. The shift of the problem from plot selection to securing the right shows that the effectiveness of the programme is measured by the share of rights carried through to registration, and the number of hectares issued reflects it only in part.
